Workshop on Cross-Border Insolvency Proceedings

This online workshop will present insolvency laws, EU legislation and major case law as well as recent developments regarding insolvency and collection proceedings post Covid-19.


Participants will get to know the differences in national insolvency laws and discuss the recent Directive on restructuring and insolvency of 20 June 2019, including early warning, access to information, preventative restructuring frameworks, restructuring plans, stay of individual enforcement actions and discharge of debt.

Implications of Brexit for insolvency and restructuring will be analysed.

 

On the second day, the workshop will focus on the EU Regulation No 2015/848 on insolvency proceedings and the growing body of case law and practice, particularly in the following fields:

  • Centre of main interest (COMI) and forum shopping
  • Coordination of proceedings 
  • Insolvency, cross-border security and rights in rem

On the third day, participants will discover how to locate assets and how rights in rem will be treated. Participants will be able to deepen their knowledge through case studies and workshops.
