Quantifying Harm in Antitrust Damages Actions

The role of the Guidance Paper

ObjectiveOn 17 June 2011, the European Commission published and opened for public consultation the draft Guidance Paper on the quantification of harm in actions for damages based on breaches of Articles 101 or 102 TFEU. The aim of the draft Guidance Paper is to offer assistance to courts and parties involved in actions for damages by making more widely available information relevant for quantifying harm caused by infringements of the EU antitrust rules.The aim of this conference is to raise awareness among stakeholders of these issues whilst giving them the opportunity to discuss with policymakers, judges and economists the likely impact of the draft Guidance Paper on private litigation concerning antitrust damages actions.Key topics• General context for quantifying harm in antitrust damages actions and the role of the draft Guidance Paper;• Main methods and techniques available to quantify antitrust harm;• The application of methods and techniques to exploitative practices;• The application of methods and techniques to exclusionary practices;• The usefulness and suitability of the draft Guidance Paper to the practical needs of judges and parties in antitrust damages cases.
