The New Regime for Planning Cross-Border Successions

EU Succession Regulation to apply from 17 August 2015Inheritance tax

ContentsThe EU Succession Regulation harmonises the conflict-of-law rules on cross-border successions of 25 members of the European Union and is directly applicable to all deaths on or after 17 August 2015. The United Kingdom, Denmark and Ireland along with Switzerland and other third countries are not directly bound by it but are also affected. By unifying the connecting factor for jurisdiction and applicable law, the EU Succession Regulation significantly improves the legal position of beneficiaries in cross-border succession cases within the 25 EU Member States concerned. However, in some cases and in particular with regard to third countries, the EU Succession Regulation may lead to unsatisfactory results. It is in any case advisable that persons with cross-border affairs in any of the 25 EU Member States review their estate planning in order to avoid unintended and undesired legal consequences. The conference will address practical problems for cross-border estates on the basis of the Succession Regulation including inheritance tax issues following the outcome of the consultation on cross-border inheritance tax problems within the EU launched in 2014. Who should attend?Lawyers in private practice and notaries involved in succession planning, tax lawyers, ministry officials and academics.
