Recent settlement agreements between the Department of Justice (DOJ) and private companies have shown that DOJ will not tolerate employers discriminating against foreign persons – even where export controls might appear a concern. At the same time, the export agencies have specific requirements that mandate certain export-controlled information to be restricted from foreign person employees and thus pushing companies to evaluate whether certain positions should be limited to persons only.
